Mr Cullinane,

I notice that towards the end of this e-mail you have confirmed that Mr Castree had requested you book a legal visit with him. This whole matter could have been resolved a lot quicker had you said this at the outset when I asked in my first e-mail, or during your first telephone call when I again requested that conformation.

The telephone number for booking legal visits at HMP Leeds is 0113 2032768 or, if you experience problems with that number, send a fax to 0113 2032872.

Dear Marion Mahoney,

Legal Special Visit with Ronald Castree: - Rule 39a - Ref No: TW6550 A3/05

We are forwarding you the chain of correspondence below, which is self-explanatory and warrants an immediate investigation.

On receiving David Pearson’s latest email this morning I rang him on: 0113 203 2745 as he had turned our request for a legal visit with our client Mr. Castree into a correspondence course, which you can see below. When I asked Mr. Pearson why he was not arranging a legal visit he became arrogant and abusive and put the phone down on me when I told him that I would go public if he did not explain his correspondence. He kept demand that that I put all my queries in writing and that he had sought legal advice.

Who did Mr. Pearson seek the legal advice from? And how many prisoners in Armley Prison have Mr. Pearson denied legal visits of their own choosing?

For the protection of the prisoners human rights at Armley Prison - under Article 6 (1) of the European Convention of Human Rights we are requesting that you suspend David Pearson immediately, as he is obstructing prisoners having legal visits of their own choosing, which is a serious violation of their human rights.

It is obvious that Mr. Pearson is fully briefed on the, “MEMORANDUM OF UNDERSTANDING BETWEEN THE ASSOCIATION OF CHIEF POLICE OFFICERS OF ENGLAND AND WALES AND THE LAW SOCIETY” - Which is illegal under Article 6 (1) of the European Convention of Human Rights. You will find that this is the reason David Pearson is blocking us having a legal visit with our client, as he is aware that we are independent of the law society and the police.

It is imperative that Mr. Castree’s rights and wishes are respected by Armley Prison authorities, as he is a remand prisoner and NOT convicted of any crime. It is preposterous that this man is being treated like this, is it not? Why is this mail, which is about Mr. Castree not been given to him at our request?

When I rang Armley Prison this morning on: 0113 203 2600 and requested the name of the person in charge of the prison, the male who answered the phone refused to give me his name and he also flatly refused to give me your email address. Who was this man as I cautioned him that it was illegal to withhold his name, as he was working in an official capacity and was obliged to give me his name? He still refused to give his name. And we now want to know the reason - Why?

If you are not the right person to deal with this legitimate complaint and arrange the requested legal visit, then please put it in the hands of the persons who can immediately.

As we feel David Pearson is a serious danger to the prisoners in Armley Prison; therefore, we are going public with this correspondence, and all future correspondence until this matter is resolved, and prisoners in Armley Prison can have Legal Visits from whoever they wish, as it is their choice: NOT the Prison authorities.

Our client Mr. Castree has requested in a letter that we arrange a legal visit with him in Armley Prison and we have agreed; therefore, the Prison authorities must honour this at our convenience.

IMPORTANT: Please forward a copy of this chain of correspondence to Mr. Castree ASAP, as David Pearson has flatly refused: - And his reasons must be investigated.

Thank you in advance for your kind assistance in ensuring that there is no further obstruction to our legal visit with our client Mr. Castree.

Yours truthfully,

Patrick Cullinane, Legal Adviser / McKenzie Friend / Caseworker for the IBRG and Victim of HM Partnerships.

Mr Cullinane,

In answer to each of your questions:

My correspondence has been with you. Should you wish to copy it to Mr Castree, please feel free.
I do not require, and have at no time asked for, any form of conformation from Mr Castree.
I have made no comments on the number of legal advisors any prisoner desires.
Thank you for your suggestion. To aid with that independent legal advice please provide details of your allegations of my obstruction.

Mr. Pearson,

Legal Special Visit with Ronald Castree: - Rule 39a - Ref No: TW6550 A3/05

Please address the following legitimate questions fully, as we feel you are now obstructing our efforts to see our client Mr. Castree:

Have you copied our exchange of emails to Mr. Castree as we requested you to do? – “IMPORTANT: Please forward a copy of this chain of correspondence to Mr. Castree ASAP”

Have you sought the confirmation you require from our client Mr. Castree yet?

Mr. Castree is entitled to as many legal advisors as he so desires: - Are you saying that he is NOT?

We strongly suggested yesterday that you seek independent legal advice on this matter: – have you done this yet? - “We strongly recommend that you seek immediately independent legal advice on this matter, as Armley Prison authorities are violating Mr. Castree human rights in denying him his rights to test other legal assistance”

Our client Mr. Castree has requested in a letter that we visit him in Armley Prison and we have agreed.

Please read my earlier response carefully, it does not state that you cannot visit Mr Castree, in fact it gives advice on how you may do so.

If you wish to make use of the legal visits facility I require conformation that you are Mr Castree's legal advisor.

Dear David Pearson,

Legal Special Visit with Ronald Castree: - Rule 39a - Ref No: TW6550 A3/05

Please peruse your email below as we are finding it difficult to understand.

We were already aware that ADL Solicitors from Leeds are on the records as Mr. Castree’s legal representatives.

It is very important that Armley Prison don’t violate Mr. Castree’s human rights under Article 6 (1) of the European Convention of Human Rights with regards legal assistance of his own choosing.

Are you saying that because Mr. Castree is in prison that he is NOT entitled to shop around for legal assistance of his own choosing?

Why do you (erroneously) feel that Mr. Castree would have to sack ADL Solicitors before you can consider our request for a legal visit? We strongly recommend that you seek immediately independent legal advice on this matter, as Armley Prison authorities are violating Mr. Castree human rights in denying him his rights to test other legal assistance. How can Mr. Castree make an informed decision with regards legal assistance of his own choosing otherwise?

If Mr. Castree were not on remand in Armley Prison he would be free to shop around for legal assistance of his own choosing? Therefore, why must Mr. Castree sack his solicitor while he shops around because he is a remand prisoner in Armley Prison???

Mr. Castree has requested that we visit him in Armley Prison and we have agreed.

IMPORTANT: Please forward a copy of this chain of correspondence to Mr. Castree ASAP

Thank you in advance for your assistance in ensuring that there is no further obstruction to our legal visit with Mr. Castree.

Yours truthfully,

Patrick Cullinane, Legal Adviser / McKenzie Friend / Caseworker for the IBRG and Victim of HM Partnerships.

Dear Mr Cullinane,

Unfortunately our records show that Mr Castree's legal representatives are ADL Solicitors from Leeds . Before I can consider your request I need conformation that this is no longer the case and you have assumed that role. This conformation I require from Mr Cullinane.

If you wish to make a domestic visit then Mr Cullinane must send out a visiting order and he is fully aware of the process.

I have tested the phone lines to our visits booking service and found both to be working and the calls to have been answered, albeit after being placed in the call queuing system but thank you for bring the matter to my attention.

Dear David Pearson,

Legal Special Visit with Ronald Castree: - Rule 39a - Ref No: TW6550 A3/05

I would be grateful if you would arrange a Special Visit for my assistant and me with the above prisoner.

Unfortunately when I tried to book this visit myself yesterday on the following telephone numbers: - 0113 203 2932 - 0113 203 2935 it was impossible as the phones were left ringing. I then rang the prison switchboard on: 0113 203 2600 and they could not help me either, when they eventually answered the phone; at this point I asked to speak to Rob Kellett and was told that he was on holidays for three weeks.

With great difficulty I obtained your name and telephone number and when I rang your number: 0113 203 2745 it was on answer phone; I did not leave a message.

Mr. Castree has requested that we visit him in Armley Prison and we have agreed.

Thank you in advance for your kind assistance with this matter

Yours with gratitude,

Patrick Cullinane, Legal Adviser / McKenzie Friend / Caseworker for the IBRG and Victim of HM Partnerships.
